The Smoking Gun article speaks of federal prosecution. From a prosecutor's point of view, this may be one of the few incidences where the harsher penalties would come from the states. Sentencing under Virginia's anti-spam legislation would actually be worse. Conspiracy under the Virginia anti-spam statute could reach up to 20 years.
Perhaps because of the statute a conviction under the Virginia law would be harder to prove. This looks as though it could be pursued by prosecutors as a garden-variety conspiracy, though.
